1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Kartzy Studio website, storefront, and any related services (collectively, the "Services") operated by Kartzy Studio ("Kartzy Studio," "we," "us," or "our"). By accessing the Services, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Services.

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order.

2. About Kartzy Studio

Kartzy Studio designs and produces 3D-printed, made-to-order goods. Each item is produced individually after purchase. We are based in the State of Florida, United States.

3. Made-to-Order Products

All products sold by Kartzy Studio are made to order. This means:

Production does not begin until your order is placed and payment is confirmed.
Each item is produced individually and may exhibit minor variations in color, finish, surface texture, layer lines, or dimensions inherent to the 3D printing process. These variations are not defects.
Estimated production times are listed on the product page and are estimates only, not guarantees.
Once production has begun, orders cannot be modified or cancelled.

4. Orders and Acceptance

Submitting an order constitutes an offer to purchase. We reserve the right to accept, decline, or limit any order at our sole discretion, including but not limited to orders that appear fraudulent, contain pricing errors, or violate these Terms. If we cancel an order before production begins, you will receive a full refund of the affected amount.

5. Pricing and Payment

All prices are listed in U.S. dollars (USD) and exclude applicable taxes, shipping, and handling unless otherwise stated. We may update pricing at any time without notice. The price applicable to your order is the price displayed at checkout.

Payment is due in full at the time of order. We accept the payment methods displayed at checkout. You represent that you are authorized to use the payment method provided.

6. Shipping and Delivery

Shipping costs and estimated delivery windows are presented at checkout. Production time is separate from shipping time and is added to the total fulfillment estimate.

Risk of loss and title for purchased items pass to you upon delivery of the items to the carrier. We are not responsible for delays, loss, theft, or damage occurring after the item leaves our facility. If your shipment is lost or damaged in transit, you must file a claim with the carrier; we will assist where reasonably possible.

International customers are responsible for any customs duties, import taxes, or fees imposed by the destination country.

7. Returns, Refunds, and Cancellations

All sales are final. Because every product is made to order, we do not accept returns, exchanges, or cancellations once production has begun.

Exceptions — we will replace or refund an item only in the following cases:

The item arrives defective, meaning it has a manufacturing flaw that materially impairs its intended use (and is not a normal characteristic of 3D printing as described in Section 3).
The item delivered does not match the item ordered.
The item arrives visibly damaged in transit and the carrier confirms the damage.

To request a remedy under this section, you must contact contact@kartzystudio.com within 7 days of delivery with your order number and clear photographs of the issue and the shipping packaging. We will respond within a reasonable time and, if approved, will issue a replacement or refund at our discretion.

This policy does not affect any non-waivable rights you may have under applicable consumer protection law.

8. Intellectual Property

All content on the Services — including designs, 3D models, product photography, text, logos, and the Kartzy Studio name — is owned by or licensed to Kartzy Studio and is protected by United States and international intellectual property laws. You may not copy, reproduce, distribute, modify, reverse-engineer, 3D-scan, re-print, or create derivative works from any Kartzy Studio product or content without our prior written permission.

Purchase of a physical product grants you ownership of that physical item only. It does not transfer any rights in the underlying design, model files, or trademarks.

9. User Conduct

You agree not to:

Use the Services for any unlawful purpose or in violation of these Terms;
Submit false, inaccurate, or misleading information;
Interfere with, disrupt, or attempt to gain unauthorized access to the Services or our systems;
Use any automated means (bots, scrapers, crawlers) to access the Services except for publicly accessible search-engine indexing;
Resell Kartzy Studio products in a manner that misrepresents their origin, authenticity, or affiliation with Kartzy Studio.

10. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at contact@kartzystudio.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

11. Third-Party Services

The Services rely on third-party providers, including Shopify Inc. for commerce infrastructure and payment processors for transactions. Your use of those services is also subject to their respective terms and policies. We are not responsible for the acts or omissions of third-party providers.

12. Disclaimers

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS REQUIRED BY APPLICABLE LAW. We do not warrant that the Services will be uninterrupted, error-free, or secure.

3D-printed products are functional and decorative items. They are not represented as suitable for food contact, medical use, structural load-bearing, child safety, or any other regulated use unless explicitly stated on the product page.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KARTZY STUDIO AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO KARTZY STUDIO FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE NINETY (90) DAYS PRECEDING THE EVENT.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Kartzy Studio and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or related to these Terms or the Services will be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue there. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. Dispute Resolution

Before filing any claim, you agree to first contact us at contact@kartzystudio.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days. If the dispute is not resolved, either party may proceed in the courts identified in Section 15.

17. Changes to These Terms

We may update these Terms at any time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated by posting the updated Terms on the Services and, where appropriate, by email. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

18. Severability and Waiver

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and Kartzy Studio regarding the Services and supersede any prior agreements.
